I already have a buyer – what are the next steps?
Once an offer has been received and the purchase price and general terms have been agreed, the following process usually takes place:
RESERVATION —–> DEPOSIT AGREEMENT —–> SIGNING AT THE SOLICITOR’S OFFICE
RESERVATION
The estate agent usually receives a symbolic deposit from the buyer in order to take the property off the market for a short period agreed between the parties.
A document is signed containing basic details of the parties, the approximate date for a deposit agreement, and an approximate date for the signing and handover of the property at the notary’s office.
From this point onwards, the property documentation is shared with the buyer or their representative so that they can review the property’s legal status and more specific terms can be established for the next payment.
DEPOSIT AGREEMENT
Once the buyer has assessed the property’s current legal status, the buyer and seller commit to this agreement, setting out deadlines, payments and costs to be borne by each party, and sign it by mutual agreement.
At this stage, a deposit is usually paid into the sellers’ account. In Spain, this is typically 10% of the sale price but may vary depending on the parties’ negotiations.
SIGNING AT NOTARY
Once the parties are ready to sign and all the documents are in order, the sale can be signed before a solicitor, with the balance of the agreed price being paid.
